A Rare Case: An 18 Year Old Who Murdered his Father Gets Bail

An 18 year old student from Worli, Mumbai was arrested for the murder of his own father on February 19, 2018. Now, four months later in an exceptionally unusual instance, the teenager was granted bail by a sessions court in Mumbai. As quoted in a TIMES OF INDIA report, the court said, “Though offence is serious in nature, accused has no criminal antecedent. Incident appears to be in the bad vices of the victim.”

The bail was granted after the court reviewed the victim’s conduct, who was found to be a habitual offender. The victim also had a criminal record and had served a seven year sentence in the rape of his sister-in-law. The father would regularly assault the mother and the accused’s sister who is merely 6 year old. The court felt it necessary to take in consideration the kind of impact such a dysfunctional family had on the accused. The court also considered other factors such as the circumstances under which the murder had taken place, the time until the trial commences, the age of the accused and also his future.

Though the prosecution had opposed to the bail plea on the basis that one cannot be granted bail only on the grounds of being at tender age. The defence put forward some strong points such as there were many complaints registered against the victim’s violent habits and also informed the court that the victim had been punished with a seven year jail sentence for attempt to murder. The defence further argued on the points that the murder was a result of the spur of moments and also pointed out that the charge sheet had nothing mentioned about the alleged killing being intentional or a cold blooded murder. The argument was supported by a statement of submission by the mother of the accused. The defence also presented to the court the clean record of the accused, who was just pursuing his education and had no criminal history.

A future could have been made brighter; a child could have been brought up in a safer environment only if a certain events were avoided and correct actions were taken.

The teenager is now ordered to be released by the court on executing a bond of thirty thousand rupees with some solvent sureties of the same amount. Though the accused is on bail, he is ordered by the court to make a visit to the Worli police station to mark his presence on the last date of every month until his trial is concluded.
