A court in Patna, on Monday, Feb 16 awarded death penalty to a private school’s principal in Phulwarisharif, Patna for raping his 11-year old student of the same school and impregnating her. The convict principal is identified as Arvind Kumar. The punishment was awarded by Additional Special Judge-cum-Special Judge POCSO Act, Awadesh Kumar, who gave a landmark judgment in the case of raping a minor. The court also found another teacher, Abhishek Kumar guilty for “common intention for committing of rape by the convicted Principal”.
The principal convict, Arvind Kumar, was also imposed a fine of Rs. 1 lac, along with a compensation of Rs. 15 lac to the minor victim. The co-convict, Abhishek Kumar, was charged with rigorous imprisonment for life for keeping common intention in the crime. Abhishek was also slapped with a fine of Rs. 50,000 along with life imprisonment.
The matter took place in 2018 when the victim, 11-year old Class V student of the school in Phulwarisharif, Patna was found pregnant. Upon inquiring more in depth, the parents discovered the victim’s ordeal. The informant, the victim’s mother, registered a case of Rape in the Mahila Thana in Patna under the POCSO Act and the Indian Penal Code.
The informant narrated in her complaint to police that the principal raped her daughter on knife point. According to her, the convict Arvind Kumar called her daughter on the pretext to check her handwriting and took advantage of her daughter’s innocence. In her accusations, victim’s mother informed police that the principal with assistance of co-convict Abhishek Kumar, made video of their crime and blackmailed the minor to rape her repeatedly. This act made her daughter pregnant, informed the victim’s mother.
The POCSO court found both the principal and teacher of school in Phulwarisharif, Patna guilty of their crime and awarded them their well deserved punishment as per the law of the land. The judgment concluded that the death sentence awarded to the principal convict Arvind Kumar “shall not be executed without confirmation by the Honourable High Court, Patna as per provisions u/s 366 of CrPC,”.
