Justice of Meghalaya HC observes India should have remained a Hindu Country at India-Pakistan Partition

The Justice S. R. Sen, reportedly, sparked a controversy on Monday after he delivered an order where he ruled that like Pakistan declared it as an Islamic country, India should have also declared itself as a Hindu nation.

A new row over Hindu nation emerged after a judge of Meghalaya High court quoted that India should have declared it as a Hindu nation at the time of India – Pakistan partition. The Justice S. R. Sen, reportedly, sparked a controversy on Monday after he delivered an order where he ruled that like Pakistan declared it as an Islamic country, India should have also declared itself as a Hindu nation. “Pakistan declared themselves as an Islamic country and India, since (it) was divided on the basis of religion, should have also been declared as a Hindu country, but it remained as a secular country,” stated Justice Sen, quoted TOI.

Notably, Justice Sen made the ruling while disposing of a petition of Amon Rana who complained of being denied domicile certificate by the Meghalaya state government. He further observed that it will be a doomsday for India and the world if India is converted into an Islamic country by anyone. “I make it clear that nobody should try to make India as another Islamic country, otherwise it will be a doomsday for India and the world. I am confident that only this government under Prime Minister Narendra Modi will understand the gravity, and will do the needful as requested above and our (West Bengal) chief minister Mamata Banerjee will support the national interest in all respect,” quoted Justice Sen in his observations, quoted TOI.

Justice Sen made few very noticeable points including the governance of Narendra Modi which according to him is the only government that can keep the nation away from becoming an Islamic country. He further emphasized that the country must be ruled under uniform law which must be equal to every citizen irrespective of their religion. He stated that anyone who refuses to follow Indian law and constitution, must not be called the citizen of the country. “Anybody opposing the Indian law and constitution, they cannot be considered as citizens of the country,” Justice Sen stated while further reminding everyone that we are Indians first, good human beings then and eventually comes our community identity, TOI reported.

Justice Sen is the lone judge in the Meghalaya High Court and has sparked the row over India being a Hindu nation. While recalling the freedom fight of India, he said, “India achieved independence through bloodshed and the worst sufferers were the Hindus and Sikhs who had to leave forefather’s property, birthplace with tear and fear and we will never forget that,” quoted TOI as stated by Justice Sen while delivering his order. India-Pakistan partition of 1947 was the most tragic division of India into two countries where Muslim majority region was parted from India naming it Pakistan while India left the decision of citizens staying on it’s territory based on the citizen’s own choice and not religion.
