Mumbai: The Supreme Court Judgement on 9th June’ 2017 has upheld the constitutional validity of 139AA of the IT Act which makes it mandatory to link an individual assesses’ Aadhar Card with that of his PAN Card is a shot in the arm for the government.
There has been much debate on this issue as it is seen as a conflict between two rights – Right to Information and Right to Privacy. The dilemma being that one man’s right to information is another man’s right to privacy. And while the Govt. means well by linking the two main identity cards which will go long way to prevent tax evasion, corruption and ensure proper utilization of Govt. schemes. It will also mean that to some extent an individual’s privacy has been compromised. Considering our low preparedness to handle cyber-theft, the move could also prove dangerous to Indian citizens, if proper safeguards are not taken into account.
As per the Govt.’s directive from July’ 1st, 2017, no income tax return can be filed if not linked to the Aadhar Card. This announcement has seen a deluge of requests to link Aadhar Card to the PAN Card on the website of the Income Tax Dept. People are under the mistaken belief that PAN Cards if not linked to the Aadhar Card by this date will become invalid. This is absolutely wrong information. The last date for invalidation of unlinked PAN cards is not yet declared by the Govt. and it will be done much later in the process.
However it does mean that from July 1st, 2017, one will not be able to apply for a new PAN number and also will not be able to file his Income Tax return, if he has not linked his Aadhar Card to his PAN Card.
The following steps are needed to link the Aadhar Card with the PAN Card:
— Visit the income tax e-filing portal at https://incometaxindiaefiling.
gov.in/ and enter your user id and password to access your profile for existing users. A new user has to first register on the portal — The website now has a pop up box asking users if they want to link their Aadhar Card with their PAN Card. It also has a ‘Link Aadhar’ ‘New’ blinker on the left-hand side of its website. The user has to click on the link specified.
Upon clicking the website then asks you for your:
PAN Card no and Aadhar Card no
Name as per Aadhar Card
Whether you have only the birth year mentioned in your Aadhar Card (This is because new Aadhar Cards have a date of birth instead of only the birth year).
The user is then requested to fill in the Captcha Code
Press on ‘Link Aadhar’ and both Card nos. now are linked.
In case there is a mismatch in the ‘Name’ as per Aadhar Card and PAN Card, then the user will have to provide an additional Aadhar OTP to proceed with the linking.
In case of ‘Gender or Date of birth’ mismatch however, the user will have to first log in separately on the Aadhar website https://uidai.gov.in/, update his Aadhar particulars and only then proceed to link both the Cards following the steps above.
